El Art=BA 87 del C=F3digo Laboral Paraguayo define que un contrato por =
tiempo
indefinido no puede ser terminado sin antes dar el preaviso. Esto rige =
para
ambas partes, es decir, tanto el empleador le debe preavisar a su =
trabajador
cuando quiere terminar la relaci=F3n laboral y viceversa. Seg=FAn la =
antig=FCedad
del trabajador se fijan los siguientes plazos para el preaviso:

a) terminado el periodo de prueba y hasta 1 a=F1o de servicio =3D 30 =
d=EDas

b) de 1 a 5 a=F1os de servicio=3D 45 d=EDas

c) de 5 a 10 a=F1os de servicio =3D 60 d=EDas

d) m=E1s de 10 a=F1os de servicio =3D 90 d=EDas

El preaviso normalmente se da en forma escrita, o sea, es una nota que =
debe
expedir o el empleador o el trabajador comunicando que desea terminar la
relaci=F3n laboral en el tiempo y plazo arriba mencionado.

En caso que el empleador omite este requisito y termina la relaci=F3n =
laboral
sin haberle preavisado a su trabajador, le debe pagar este tiempo, =
seg=FAn la
escala m=E1s arriba.

Pero tambi=E9n el trabajador est=E1 obligado a dar este preaviso. En =
caso que el
lo omite, le debe pagar a su empleador el equivalente a la mitad del =
tiempo
seg=FAn la escala mencionada m=E1s arriba.

El derecho a vacaciones est=E1 legislado dentro del C=F3digo laboral de
Paraguay, en su libro II, t=EDtulo III,  titulado =93De las Vacaciones =
Anuales
Remuneradas=94.

A continuaci=F3n encuentra las respuestas a tus inquietudes sobre =
vacaciones:

Duraci=F3n del feriado anual

Todo trabajador tiene derecho a un per=EDodo de vacaciones remuneradas =
despu=E9s
de cada a=F1o de trabajo continuo al servicio del mismo empleador, cuya
duraci=F3n m=EDnima ser=E1:

a) Para trabajadores de hasta cinco a=F1os de antig=FCedad, doce d=EDas =
corridos;

b) Para trabajadores con m=E1s de cinco a=F1os y hasta diez a=F1os de =
antig=FCedad,
diez y ocho d=EDas corridos; y,

c) Para trabajadores con m=E1s de diez a=F1os de antig=FCedad, treinta =
d=EDas
corridos.

=BFQu=E9 ocurre si renuncio o me despiden y aun no me tom=E9 las =
vacaciones?

Cuando el contrato de trabajo termine sin haberse hecho uso de las
vacaciones ya causadas, este derecho se compensar=E1 en dinero, en base =
al
salario actual, y el monto ser=E1 doble cuando la compensaci=F3n debe =
abonarse
por despido ocurrido despu=E9s del per=EDodo de goce.

Si el contrato termina antes del a=F1o, por causa imputable al =
empleador, el
trabajador tendr=E1 derecho a que se le pague la parte proporcional por
vacaciones, en relaci=F3n al tiempo trabajado
